Crime Code — Terms of Use

These Terms of Use ("Terms") govern your use of the Crime Code iOS app and the silversprojects.com website (together, the "Service"), provided by Mike Silvers ("we," "us," or "our"). By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What Crime Code does

Crime Code is an informational legal-reference tool. You describe an activity in plain English or enter a statute citation, choose which statute sources to include, and Crime Code:

Core lookup works offline, requires no account, and processes your searches on your device.

2. What the subscription does for you

Crime Code's core lookup — search, the on-device plain-English explanation, the authoritative statute text, and history — is free to use.

An optional subscription ("Crime Code Premium") gives you:

The subscription is sold and billed through Apple (see §3); the price, billing period, and trial details are shown by Apple at the point of purchase and in your Apple Account settings. Contributing is opt-in and off by default, even with an active subscription (see §5).

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, current, or complete, or that the statute data or summaries are accurate or up to date.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS ARISING FROM YOUR USE OF — OR RELIANCE ON — THE SERVICE OR ANY INFORMATION IT PROVIDES, EVEN IF ADVISED OF THE POSSIBILITY. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

10. Indemnification

You agree to indemnify and hold us harmless from claims, damages, and expenses arising out of your misuse of the Service, your violation of these Terms, or your reliance on the Service as legal advice.

We may suspend or terminate your access to the Service (or features such as contributing) at any time for violation of these Terms or to protect the Service. You may stop using the Service at any time; provisions that by their nature should survive (e.g., §§4, 5, 7–10, 13) survive termination.

12. Changes to the Service and these Terms

We may modify the Service or these Terms. We will post updated Terms here and revise the "Last updated" date; material changes will be communicated by posting the updated Terms on this page. Continued use after changes means you accept the updated Terms.

13. Governing law and disputes

These Terms are governed by the laws of the State of Maryland, USA, without regard to conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in Maryland.

14. Apple App Store (additional terms)

These Terms are between you and us, not Apple, and Apple is not responsible for the app or its content. To the extent you obtained the app through the Apple App Store, the Apple Licensed Application End User License Agreement (EULA) also applies; in any conflict between these Terms and the Apple EULA regarding the app, the Apple EULA governs for that conflict. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Apple has no obligation to provide maintenance or support for the app, and any product warranty/legal-compliance/IP-claim responsibilities are as described in Apple's standard EULA.
